The procedure for paying pensions to working pensioners significantly different on how they are produced to unemployed citizens. In addition, many Russians are concerned about rumors about the full pension, which have become more active on the Internet against the backdrop of government changes to the pension system.

It should be noted that the decision to cancel pensions for citizens who continue to work cannot be implemented on practice. The right of citizens to an insurance pension, due to or guaranteed by the Constitution, therefore, such information disseminated by incompetent sources is unreliable.

Will there be indexation of pensions for working pensioners in 2019?

No fundamental changes in pension provision for working pensioners in 2019 not expected- for them, the procedure for pension payments will be preserved, which was carried out starting from 01/01/2016, when a moratorium on pension indexation was introduced.

For working pensioners, the cost and value are “frozen” at the level that was established at the date of retirement or until January 1, 2016. This means that the annual indexation of these values ​​carried out by the Government does not in any way affect the pension provision of working citizens - while they work, their pensions remain at the same level.

The Government does not intend to change this approach, as stated by First Deputy Prime Minister and Minister of Finance of Russia Anton Siluanov during his speech on June 27, 2018 in the Federation Council, expressing the Government’s position on this issue. The head of the Ministry of Finance noted that It is inappropriate to change the current approach, since it is fair for certain reasons:

  1. According to the Government, the real income of pensioners who continue to work is already growing steadily(even without indexation of pensions). It happens due to high rates of wage growth, which, according to Rosstat data, has been observed in recent years and is predicted in the future.

    As an example, the Government notes that in the first half of 2018 alone in Russia there was salary growth by 9%. At the same time, indexation of pensions for non-working pensioners has been carried out in recent years at the level of 3-4%.

  2. the amount of pension benefits paid to him will be recalculated - according to the adopted legislation, starting from the next month after his dismissal, he will be fully taken into account all missed pension indexations over the years of continued work activity.

Based on this, the Government believes that it is advisable to maintain the approach to the payment of pensions to working citizens, adjusted in 2016, since this fully fits into the plans of the Cabinet of Ministers to ensure high growth rates of population income: for non-workers - due to increased indexation, and for working people - only due to increased wages and various benefits (including) provided for pensioners.

What will happen to the pensions of working pensioners in 2019

Pensions of citizens who continue to work will be increased in 2019 only as a result of recalculation, which automatically produces the Pension Fund from August 1. As a result of such recalculation, an increase in pension will be assigned, which is determined based on from insurance premiums paid over the past year.

Let us note a number of features that affect the size of the increase in August 2019:

  1. Paid for the past year of work are taken into account, i.e. in 2019, generated pension points (IPC) will be taken into account due to insurance premiums paid in 2018.
  2. Number of points taken into account when recalculating limited to three IPCs, i.e. all accumulated points exceeding this value will only be taken into account in the next year (i.e. 2020).
  3. Due to the “freezing” of indexation for working citizens, the cost of one IPC for them is fixed at the level that was established on the date of retirement.

Based on this, in 2019 the pension for working pensioners will be increased only from 01.08.2019., and the maximum amount of the increase will be limited to the value of three pension points - i.e. no more than 244.47 rubles. The earlier a citizen receives pension payments, the lower the cost of one IPC is for him, which means the increase will be less than 244.47 rubles. No more changes to pensions for working Russians in 2019. not expected.

For comparison

The government will implement at a rate exceeding the rate of inflation, which will allow them to increase annually on average 1000 rubles. Thanks to this, by 2024 the national average level of pensions for non-working pensioners is planned to increase from 14 to 20 thousand rubles.

Since there is a moratorium on indexation for working pensioners, such a significant increase in pensions will not affect them. How, the Cabinet of Ministers believes that it is possible to fully increase the incomes of working citizens real wage growth, so there is no need to additionally index their payments.

Cancellation of pensions for working pensioners

Question about the abolition of pensions for working pensioners has already been raised several times, and in connection with the start of the program proposed by the Government in 2019, it began to be discussed even more actively. However, at a meeting of the Council under the President of the Russian Federation for the development of civil society and human rights, which took place on July 11, 2018, Deputy Minister of Labor and Social Protection Andrei Pudov said that payments to working pensioners we don't intend to cancel. “No, such a plot is not considered”, - said A. On August 11, 2018, State Duma Chairman Vyacheslav Volodin, at a meeting with residents of the Zavodsky district of Saratov, stated that The pension system budget is in deficit, which generally casts doubt on the further payment of state pensions. But the speaker of the State Duma said this, justifying the need for adoption, which will solve the problem of the deficit budget, and, consequently, the issue of further payments to pensioners. Therefore, V. Volodin’s statement cannot be interpreted as a decision to cancel pensions- this is only an indication of the existing problems of the Pension Fund budget.

In Russia, the right to receive a pension in cases provided for by law is secured by Art. 39 of the Constitution. Therefore, only the conditions for retirement (for example, retirement age) can be adjusted, but Pension payments cannot be completely cancelled.- this contradicts the highest legal act of the country.

It should be noted that the issue of abolishing pension payments to working citizens was raised by the Government much earlier. In 2016, the Ministry of Finance already proposed limiting the right to receive a pension to certain categories of working pensioners:

  • Completely cancel pensions for those citizens who have annual income more than 500 thousand rubles.(later it was also reported that this limit was increased to 1 million rubles).
  • Do not pay a fixed payment to the insurance pension (in 2016 it was 4,559 rubles) if a pensioner's income exceeds 2.5 subsistence minimums.

Later, Olga Golodets (who at that time held the position of Deputy Prime Minister for Social Affairs in the Government) reported that such a bill had actually existed for several years, but it no discussion taking place.

Against the backdrop of the ongoing pension reform, information has even begun to spread among the population that, from 2020, pensions will not be indexed even after dismissal, therefore it is recommended to receive an indexed pension before the introduction of new rules.

In general, regarding the pensions of working pensioners in 2020, the following can be noted:

Indexation of pensions for working pensioners in 2020

Pensions of working pensioners from January 1, 2020 will be paid according to the same principle that has developed since the abolition of indexation of payments for this category of Russians. So, from January 1, 2016, pension provision for them remains at the same level that was determined upon retirement. It can only increase as a result of taking into account additional insurance premiums paid during the period of official work, which happens annually from August 1.

How it works:

  • Since 2016, for working pensioners, the cost of one and the size have not increased, taking into account rising prices in Russia (inflation level), as happens annually for non-working citizens.
  • These parameters for working pensioners are fixed at the level that was established on the date of retirement. And, therefore, due to indexation, the amount of the pension benefit received does not increase.

Thus, in 2020, due to the current moratorium on indexation of pensions for working pensioners, the cost of the IPC and the fixed payment for them will remain at the same level, which means that the government promised for this category of citizens will not be made.

However, all missed indexations during work for this category of pensioners will be taken into account in the final determination of the amount of payments.

Will indexation be returned to working pensioners?

Return to indexation for working citizens Government doesn't plan. Although President V. Putin and Prime Minister D. Medvedev have repeatedly stated that they will work on the issue of “unfreezing” indexation, subject to an increase in federal budget revenues.

But the final position of the Government was voiced by Russian Finance Minister and First Deputy Prime Minister Anton Siluanov. He said that changing the current approach to paying pensions to working pensioners during the pension reform is inappropriate. And as a justification for such a decision, the head of the Ministry of Finance cited the following reasons:

  1. The task set by the so-called “May Decree” of the President is to ensure a high growth rate of incomes of Russians, which in relation to working pensioners in recent years has already ensured by rising wages.
  2. For example, over the first 9 months of 2019, according to Rosstat, wages in Russia increased by 6.3%.
  3. In addition, after dismissal, the pensioner will still have his pension amount recalculated, taking into account all indexations missed since 2016. In other words, the “freezing” of pensions for working pensioners is valid only during the period of their work and does not cancel the pensioner’s right to annual indexations missed for this reason.

For these reasons, the Government does not plan to change the procedure for pension payments for working Russians and restore indexation for them due to the fairly high growth rates of wages. This fits into the Government’s concept of ensuring income growth for the population: for non-working people, income growth is achieved as a result of indexation, and for working people - through an increase in salaries.

Will there be an increase in pensions for working pensioners in 2020?

The 6.6% increase in pension payments approved on January 1, 2020 will not affect working pensioners due to the moratorium in force since 2016. Therefore, an increase in pensions for this category of citizens will be carried out in 2020 only from August 1 as a result of an undeclared recalculation. It is being carried out automatically based on the data that, according to the law, employers send monthly to the Pension Fund.

The additional payment from August 1 is made by taking into account the pension points (IPC) generated in the amount of the pension benefit by paying insurance premiums during the pensioner's working life. The recalculation procedure has several significant features that significantly affect the size of the increase:

  • IPCs formed through payment are taken into account last year. This means that when recalculating from 08/01/2020, insurance premiums for the period of work in 2019 will be taken into account.
  • The size of the increase is determined as the number of accumulated pension points multiplied by the cost of one IPC. But there are a number of limitations here:
    • the cost of 1 IPC for a working pensioner is fixed at the level that was established on the date of retirement (due to the “freezing” of indexation for them);
    • the number of points taken into account is limited to only three (3 pension points in 2019 amount to 261.72 rubles).

This means that the amount of the additional payment will depend on the date of registration of pension payments by the citizen. The earlier a pensioner applies for benefits, the smaller the increase will be assigned for him from August 1, 2020 due to missed point indexations.

The maximum amount of the increase in 2020 will be provided to those citizens who received payments during 2019 and accumulated 3 pension points after retirement. The additional payment will be 261.72 rubles. In any other cases, the increase will be less than the specified amount.

Will working pensioners be paid pensions in 2020 in Russia?

In connection with the pension reform carried out by the Government, rumors began to actively spread about abolition of pensions for working pensioners. However, on July 11, 2018, Deputy Minister of Labor and Social Protection A. Pudov announced that such a decision would not be made within the framework of changes to the pension system planned by the Government. Working pensioners will continue to receive pensions.

It is worth immediately noting that Art. 39 of the Constitution guarantees the right of a Russian citizen to receive a pension benefit in cases provided for by law: upon reaching retirement age, upon receipt of disability, or in the event of the loss of a breadwinner. Therefore, it is impossible to completely cancel pension payments - you can only adjust individual conditions for receiving it (for example, raising the retirement age).

It should be noted that against the backdrop of the consequences of the economic crisis in 2016, the Ministry of Finance has already received a proposal to limit the right of working pensioners to receive a pension in certain cases:

  • If a pensioner has annual income more than 500 thousand rubles.(in a softer version of the proposal - 1 million rubles), it was proposed to completely abolish pension provision for them.
  • If the monthly income of a pensioner is more than 2.5 subsistence minimums, it was proposed to abolish the fixed payment to the insurance pension for such citizens (then, in 2016, it was 4,559 rubles).

Such a proposal was never considered or implemented. Although Olga Golodets, who held the position of Deputy Prime Minister for Social Policy in 2016, stated that such a bill had nevertheless been prepared, but in the Government was not discussed further.

Do I need to quit before November 2020?

The implementation of pension reform in Russia began to be accompanied by another rumor - allegedly working pensioners must resign before November 2019, otherwise in 2020 they will be deprived of the right to count in the amount of their pension all indexations missed over the years of work. Against this background, in a number of regions of the country, pensioners actually began to resign en masse, and the Pension Fund began to receive numerous requests for clarification of the situation.

In fact, not a single law contains any provisions according to which working pensioners could be deprived of the right to receive full pension indexation after dismissal. Therefore, the information disseminated is unreliable.

In fact, there is no need to dismiss pensioners before the end of 2019, since in 2020 the indexation procedure after dismissal will remain the same. An increased pension will be assigned from the 1st day of the month following dismissal. At the same time, it is necessary to understand that a citizen who quits receives an increased pension with a delay - three months after dismissal. This is due to the peculiarity of the process of transferring information from the employer to the Pension Fund, but all increases for months of delay will be compensated in full.

For example:

  • Let's assume a pensioner stops working in January 2020. Accordingly, when calculating a pension, starting from the month of February, he will be considered as unemployed.
  • In March, the Pension Fund will receive reports from the former employer, according to which the citizen will be listed as no longer working.
  • In April, the Pension Fund will make a decision on recalculating the pension amount and taking into account all missed indexations.
  • In May, the pensioner will receive an increased payment amount, as well as additional payment for February, March and April.

If a pensioner works, then inflation is not as scary for him as for his non-working “colleagues”. Deputies were guided by this consideration when they canceled the indexation of pensions for those who continue to work in their twilight years starting from the New Year. However, in the final version, the amendments turned out to be mild - the deputies decided that after stopping work, the pensioner would be compensated for all missed indexations.

The bill on this topic was finally adopted by the deputies. The first version of the document on the pension topic was much more cruel. Non-working pensioners were also supposed to have their indexation reduced. Insurance pensions were supposed to increase by only 4% (from February). It was proposed to carry out the second indexation - according to actual inflation - if there was money in the budget.

However, the Committee on Labor, Social Policy and Veterans' Affairs rebelled against this formulation. It insisted that insurance pensions be increased according to real inflation without fail. The same applies to social pensions, explained deputy chairman of the committee Irina Sokolova.

All this applies to non-working pensioners. But those who continue to work in retirement will remain without indexation. This is a permanent and not temporary norm, explained Deputy Minister of Labor Andrei Pudov.

LDPR deputy Anton Ishchenko, during the consideration of the amendments, recalled that there are about 14 million such pensioners in the country. What happens, inflation will “eat up” their pensions?

Andrei Pudov explained that working pensioners have the opportunity to receive income other than pensions. And with this money “they compensate for inflationary costs.” Answering questions, he explained that budget savings from this will amount to 438 billion rubles next year. And in conditions of difficult economic conditions, this money is much more needed by those pensioners who, for one reason or another, cannot work.

It is important that when the pensioner stops working, indexation will resume. And if the employer “forgets” to indicate in the reporting about the fact of his dismissal, then the missing funds will definitely be credited to the pensioner, they promised in the relevant committee.

Moreover, after finishing his working life, the pensioner will eventually remain, as they say, “with his own people.” “It is clearly stated that when a pensioner stops working, the amount of his pension will be increased by all indexations missed during his work,” explained Irina Sokolova.

The deputies managed to save maternity capital from inflation. The relevant Committee on Family Affairs approved the extension of the relevant program for two years, as instructed by the President. However, as in the case of pensions, the indexation of “mother’s money” to the amount of real inflation was questionable. “There were concerns about this,” the head of the committee, Olga Epifanova, shared with reporters. “After all, in 2016, payments will not be indexed. Now, according to the document, the maternity capital program until 2018 will be paid according to the amount of actual inflation.”

According to the Ministry of Economic Development, inflation will be 6% in 2017 and 5.1% in 2018. If the forecast comes true, the amount of payments will have to be 480 thousand rubles in 2017, and 505 thousand rubles in 2018. Cancellation of pension indexation from 2016

Due to the difficult economic situation in the country at the end of 2015, the Government of the Russian Federation made a decision from 2016 do not index pension payments working pensioners. How is pension provision recalculated upon dismissal in 2019?

For pensioners who quit or plan to stop working before the end of 2019, after dismissal, recalculation will be made only after a certain time; as a rule, this procedure lasts for several months. It's connected with:

  • introduction of monthly reporting employers (insurers), since currently the employer himself submits reports on his employees for the previous month before the 15th day of the current month (that is, a citizen who quit this month will still be listed as employed next month);
  • consideration by the Pension Fund of the Russian Federation information received from the employer and making a decision on the payment of security to the pensioner, taking into account all increases;
  • rules for payment of funds to the Pension Fund of Russia, that is, the insurance pension will be paid taking into account all the required indexations only from the next month after the Pension Fund makes such a decision.

The procedure for indexing pensions after dismissal in 2019

For working pensioners planning to stop working in 2019, the establishment of required increases and payment of indexed insurance pensions will change, i.e. The period for calculating the required increases will be changed.

This became possible thanks to the adopted Federal Law No. 134-FZ of July 1, 2017, which amended part 3 of Article 26.1 of Federal Law No. 400-FZ. The law was signed by the President of the Russian Federation in mid-2017 and came into force from January 1, 2018.

From what month is the pension indexed after termination of work?

In accordance with the new Federal Law, indexation of pensions of working pensioners after termination of employment is in effect from the first day of the month, following the month of the citizen’s dismissal.

In 2019, pension benefits are indexed only after the Pension Fund of the Russian Federation makes an appropriate decision, which is established only after 3 months of dismissal. That is, the pensioner does not immediately receive a pension in the appropriate amount. This innovation will not shorten the establishment period, but will allow pensioners who quit next year to receive already indexed payments from the month following the month of dismissal.

Thus, the pensioner will be able to receive full pension benefits only after the same several months after stopping work, but these months will be his compensated. Compensation will be expressed in the form of payment of the difference between the previous and increased amounts of security for the previous months (from the 1st day of the month after dismissal).

A pensioner has stopped working, what actions should he take: should he be reported to the Pension Fund?

Since 2016, it has been introduced for all employers monthly simplified reporting, according to which policyholders are required to submit information about each of their employees to the Russian Pension Fund. This reporting provides information about all officially employed or retired insured persons for the previous (reporting) month.

On termination of labor activity of pensioners who are self-employed population(individual entrepreneurs, notaries, lawyers, etc.) The Pension Fund of the Russian Federation is informed by the Federal Tax Service.

A citizen also has the right to submit a corresponding application to the Pension Fund. on one's own. This can be done through the territorial bodies of the Russian Pension Fund, as well as the Multifunctional Center (MFC). The application form for the fact of termination of work and (or) other activities is available on the official website of the Pension Fund. Like any other application, this document can be submitted to the authorities in one of the following ways:

  • personally;
  • through a legal representative (for example, with a notarized power of attorney);
  • by mail;
  • remotely through the citizen’s Personal Account on the official website of the Pension Fund.

In any case, the fact of termination of work or other activity will be determined automatically by the Pension Fund. And the application submitted by the citizen will be taken into account no earlier than the submission of information from the policyholder or the Federal Tax Service. Thus, provide information about termination of employment to a pensioner independently not necessary.

When will the indexation of pensions for working people be returned?

The legislation of the Russian Federation does not say anything about the validity period of the cancellation of indexation for working pensioners. That is, at present there is no officially confirmed information about when the planned increase will again apply to all pensioners in the country, without exception. It was also previously stated that the draft law on the federal budget would resume indexation for working recipients of insurance pensions not provided until 2020.

At the moment, the Government of the Russian Federation, in connection with the current economic situation in the country, plans to apply this measure until the crisis situation stabilizes. However, at present, only one thing is known for sure - the abolition of indexation of pensions for working pensioners will be valid in 2019.

Until 2016, a citizen who retired and continued to work received pension indexation twice a year on an equal basis with citizens who completed their working career. Due to a shortage of funds in the Pension Fund budget, the Government of the Russian Federation introduced a moratorium on these payments, maintaining indexation only for pensioners who do not have other sources of income.

Will pensions be indexed for working pensioners?

The amount of indexation of pension payments, carried out for all recipients twice a year, depended on economic indicators:

  • inflation rate;
  • reduction in the purchasing power of citizens.

In 2015, the Government of the Russian Federation considered that the annual income of pensioners continuing to work was growing due to increased salaries and sharply exceeded the income of non-working people. Due to the unstable economic situation in the country, unpopular measures had to be taken.

In accordance with new legislative norms, indexation of pensions for working pensioners has not been carried out since 2016. It will be fulfilled for all the years while the citizen worked, only after dismissal.

Refusal of indexation and reduction of payments have allowed the federal budget to save 12 billion rubles since 2016. There are no plans to return to previous norms in the coming years.

Legal regulation

Indexation for working pensioners was suspended by Federal Law No. 385-FZ of December 29, 2015, amending the laws “On State Pension Provision in the Russian Federation” and “On Insurance Pensions”.

State Duma deputies proposed for consideration several bills to restore the indexation of pension payments for working pensioners, but these initiatives received negative feedback from the Government of the Russian Federation due to the inability to allocate funds for this. Consideration of the following bills was postponed indefinitely:

Recalculation of pensions from August 1, 2019

For citizens who continue to work after receiving a pension, as well as for other employees, enterprises transfer insurance contributions.

Payments made for the previous year are transferred to IPC - individual pension points (coefficients). They determine the amount of the annual recalculation carried out on August 1 - the only increase that pensioners who continue to work can currently count on.

The pension fund performs recalculation automatically, without a citizen’s application. The increase is carried out for the following types of social insurance benefits: old age, loss of a breadwinner, disability. To receive a recalculation of the amount of pension benefits from August 2019, the following conditions must be met:

  • official salary of at least 21.9 thousand rubles per month (exceeding amounts do not affect the number of IPK);
  • contributions to the Pension Fund (PF) by the employer;
  • the amount of IPC for the previous year (only 3 are recorded);
  • date of first accrual, which determines the value of 1 point.

There are the following features of the annual recalculation for 2019:

  • the amount of the increase is calculated individually;
  • take into account all contributions made in 2017;
  • Only 3 points count, regardless of the amount of deductions;
  • the cost of 1 IPC is affected by the date of retirement, the largest value is 81.49 rubles;
  • social benefits increase to a maximum of 244.47 rubles.

The procedure for indexing pensions after dismissal

When a person finishes working, according to Law No. 134-FZ of July 1, 2017 “On Insurance Pensions,” his pension payments will be recalculated. Compensation will be made for all years of work. The procedure for indexing pensions for working pensioners after dismissal is as follows:

  • the calculation is carried out from the 1st day of the month following the termination of work;
  • payments begin after 3 months, which is due to the timing of documents;
  • the amount not received for this period will be fully compensated;
  • In the case of a new job, the amount of social contributions will not decrease.
