Does the pension depend on length of service?

Pension legislation has undergone significant adjustments over the past decade, and today new formulas are used to determine security. The formation of pension payments according to the new rules is based on the principle of stimulating a person’s desire to work longer in order to receive decent funds in old age. As a result, the determination of payments is significantly influenced by length of service, especially long-term work experience – more than 35, 40 years.

The government strives to improve the quality of life of Russians of any age group. A bonus increase in pension benefits for long-term work demonstrates a favorable financial result for both pensioners and the state budget. It is important to understand that the amount of security depends not only on the amount of time worked, but also on officially received labor income and contributions paid by the employer.

The insurance part of the pension consists of a fixed amount, a fixed amount, which is the same for everyone (for 2020 - 4982.9 rubles) and points earned by the pensioner, multiplied by the cost of the point. Minimum experience

The procedure for calculating and exercising a Russian’s right to insurance coverage is regulated by Law No. 400-FZ “On Insurance Pensions”. Legal regulation

Russian legislation in the field of insurance pension accruals consists of a number of regulations. The main norms are laid down by Laws No. 167-FZ “On Compulsory Pension Insurance in the Russian Federation” and No. 400-FZ “On Insurance Pensions”. Given that the formation of security for old age depends on insurance contributions, the work experience of a pensioner may be affected by receiving an additional payment to the main monthly part and other factors. Duration of activity of 35 years (women)/40 years (men) increases payments by establishing an additional supplement for the person as a labor veteran. The additional payment, as well as the decision to confer a veteran title, is determined by the social security institutions in the region where the pensioner lives.

The amount of additional payments is influenced by the industry of work, area of ​​residence and work, and the presence of salary bonuses. It should be clarified: this monetary increase is due if the applicant is already receiving old-age benefits. In addition to the bonus, the pension after 40 years of service is increased due to a number of benefits, some of which are translated into monetary terms. Each additional year gives bonus points:

  • one point – for a working life of 35 years for men, 30 for women;
  • five points for work duration: 40 for men, 35 for women.

What periods are taken into account?

In order to receive a pension recalculation based on length of service and additionally receive point coefficients for a long period of work, it is not necessary to work for the required number of years. The legislation provides for the inclusion of non-working periods, which are also included in the final length of service. These include:

  • military service;
  • maternity leave;
  • caring for a disabled person (an adult of the 1st group or a child), a person over 80 years of age;
  • the period of registration as unemployed with the employment authorities;
  • period of incapacity for work due to illness (if sick leave is available).

Education is not included in this list. Since insurance deductions do not occur during such time periods, the duration of the period directly affects the formation of the insurance part - the longer they are, the lower the payments. So, the points awarded are:

  • compulsory military service – 1.8;
  • care for children under 1.5 years old - first 1.8; second 3.6; third/fourth 5.4;
  • care for the disabled and the elderly – 1.8.

Conditions of receipt

Some pensioners have an unconditional opinion that additional coefficients are automatically awarded for 40 years of work. The legislation did not provide for an increase in security specifically for long-term employment after a Russian retires on retirement. If the pensioner is not a labor veteran, then there are no separate, special benefits for long service.

At the same time, an increase in pension for 40 years of service, provided there is enough time worked to qualify for a veteran’s title, is not the only basis on which it is possible to receive an additional payment to the pension. The duration of total output affects the increase when:

  • length of service was not taken into account when creating security (for example, there was no supporting documentation);
  • the pensioner continues to work.

The benefit for a pensioner who has worked in hazardous work is calculated in the standard manner. Its size depends, first of all, on the employer’s insurance contributions, the amount of which is determined by the category of danger of the employee’s work. Harmfulness is assigned by the certification commission. If the profession is recognized as dangerous, the employer is obliged to additionally transfer insurance funds. The contribution amount is, as a rule, 20-30% of the employee’s monthly income according to the payroll.

Amount of surcharges in regions

The amount of the pension supplement for 40 years of service if a Russian has Veteran of Labor status is fixed, but the amount depends on the place where the pensioner lives. Legal regulation on the decision whether to pay extra for long-term work experience is the responsibility of the constituent entities of the Federation, and funding comes from local budget sources. Veterans' cash compensation for home telephone payments is also provided. The monthly municipal payment for Muscovites is 495 rubles. The decision to index the EDV is also made annually at the local level.

For military pensioners

Both civilian and military pensioners have the right to state benefits for their length of service - to a pension upon reaching age. A second civil pension upon reaching certain years is assigned if insurance premiums have been paid for at least five years. The insurance part is provided for those persons who already have military support and continue to work in any civilian institution. In order to issue an addition, the following should be submitted to the Pension Fund department along with the application for recalculation:

Working in the Far North

Russians who have worked for a long time in harsh, remote northern conditions will be able to claim payments from the state before the required standard age mark is reached. Thus, a man who has worked in the Far North for fifteen years or in territories equivalent to it for twenty years or more will be able to go on vacation from the age of 55.

For women, with a total work experience of 20 years and a similar duration of work as for men in the Far North (15 years), this threshold is 50. For representatives of professions - reindeer herders, hunters, fishermen, who both work and live in this area, early retirement five years earlier than in the example given here, that is, for men - from the age of fifty.

Pension recalculation

The size of the increase in pension for a long-term working activity of a retired citizen differs from the nature of the expected bonus for the following reasons:

  1. The applicant provided additional certificates, extracts, and documents that were not previously taken into account.
  2. Contributions were identified that were not taken into account for various reasons.
  3. Additional criteria have appeared that affect fixed payments.
  4. Insurance premiums are recalculated when a pensioner who is already receiving benefits from the state stops working.

  • the applicant began his career as a minor during the Great Patriotic War with a final labor output of 40 (men) and 35 (women);
  • awarding the applicant departmental badges for merit in a specific production field for a period of 15 years or more with an insurance period of 25 (men)/20 (women) or length of service required for pension purposes;
  • the presence of government, presidential awards (orders, medals, certificates) and honorary titles of the Russian Federation or the USSR.

The regulations for awarding the title are the responsibility of legal decisions of federal subjects of Russia. Persons awarded departmental labor distinctions as of June 30, 2016 retain the right to be awarded a title with a minimum of 25 years of experience for men/20 years for women on the condition that the insurance period corresponds to the assignment of pension payments for length of service in the calendar period.

It is not so easy to formalize the title, since controversial issues often arise, mainly due to departments approving their own awards. Each industry independently approves awards, and the constituent entities of the Russian Federation themselves develop a list of departmental awards, taking into account the industry-specific production specifics of the region. To confirm the eligibility of existing awards, they must comply with all the grounds:

  • requirements for the establishment of departmental honorary insignia in accordance with Government Decree No. 578;

The main provision for labor veterans in old age is an old-age insurance payment, which is calculated on a principle similar to that for all citizens. The value usually depends on the parameters of the long insurance period, retirement age, and salary. The increase is provided by:

  • indexation of payments taking into account inflation;
  • establishing a social supplement up to the regional subsistence level;
  • assignment of monetary payments and compensation.

The monthly additional payment is assigned from the regional budget, so the volume of the package of social veteran benefits is different for each region of the country. In some cases, a citizen can use monthly receipt of money instead of available services (these options are determined by the local legislation of the constituent entity of the Russian Federation).
